3 suspects in shooting of Eastleigh businessman detained 10 days

The suspects will be in custody until April 22, when a court will rule on the DCI's application to hold them for 21 days.

Three people arrested in connection to a violent robbery in Eastleigh, in which a businessman was shot and wounded and his Sh4 million stolen, will remain in custody for 10 more days as investigations take place.

Julius Osoro, his wife Charity Njeri Kimani and John Michael Muturi were arrested at the Greenpark estate in Athi River, Machakos County, on Tuesday.

A report says police found a Ceska Pistol with seven bullets, vehicles suspected to have been stolen, multiple logbooks and assorted ATM cards.

The suspects will be held at the Ruaraka Police Station in Starehe, Nairobi, until April 22, 2024, when a Makadara court will rule on an application by the Directorate of Criminal Investigations (DCI) to detain them for 21 days.

Sergeant Frederick Obiero of the Starehe DCI office had applied to detain the three amid the probe into the robbery, in line with Section 295 as read with 296 (2) of the Penal Code.

Obiero wants to establish whether the gun found on the three was used to shoot trader Adan Ali Mohamed during the ambush reported at the Eastleigh North Police Station, vide OB26/30/3/2024. He said the gun will be taken to ballistics experts at the DCI's headquarters for analysis.

Obiero also said detectives need the time to identify the owners of cars, logbooks and ATM cards, as well as a laptop and an iPad that the suspects were also found with, and analyse their phones. He added that the suspects were also found with items including car sale agreements, wrist watches.

The businessman was attacked along Muratina Road in Eastleigh, by robbers on a motorcycle who trailed him from the BBS Mall, where he had intended to deposit the money into his bank account. He found the bank closed.

In an affidavit filed before Principal Magistrate Irene Gichobi of the Makadara Law Courts, Obiero said Adan was shot once in the neck and that the bullet exited through the upper spinal cord.

He is in an intensive care unit at the Health Gate Hospital for the treatment of spinal cord injuries.

"The attackers, who were riding on an unidentified motorcycle, trailed the victim, who was aboard a motorcycle from BBS Mall. Upon reaching Bulshow Carwash along Muratina Road, they blocked the victim, shot him in the neck and fled the scene. [They] made away with the victim's cash, USD 30,635, to an unknown place, on a motorcycle whose details were not captured," the affidavit states.

It added that the first respondent (Osoro) had several pending cases of criminal activities, including the theft of motor vehicles, two of them at the Kibera and Milimani courts.

The suspects opposed the application through lawyer Moses Nyamanga, who told the court that the couple had left their two children in the care of a nanny who would likely leave them unattended. Muturi is Kimani's cousin.

The lawyer further argued that the DCI's investigations, including the identification of vehicles, logbooks and electronics, as well as the ballistic examination of the firearm, did not require his clients' incarceration.

The court will rule on the application after receiving the children's officer's report.
